Terms of Service

1. Acceptance of Terms

By accessing or using CinematicAI, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our platform.

2. Third-Party API Compliance (YouTube & Instagram)

CinematicAI provides automation tools that post directly to your social media accounts on your behalf. By utilizing our YouTube automation features, you explicitly agree to be bound by the YouTube Terms of Service. We are not responsible for any strikes, demonetization, or bans placed on your channel by YouTube or Meta (Instagram) resulting from the content generated or the frequency of your automated uploads.

3. The "Bring Your Own Key" (BYOK) Architecture

CinematicAI operates partially on a BYOK model. You are required to provide your own valid API keys for third-party AI services (e.g., OpenAI, ElevenLabs). You acknowledge that:

  • You are solely responsible for paying any usage fees directly to OpenAI, ElevenLabs, or other integrated API providers.
  • CinematicAI is not liable for unexpected API charges incurred due to high-volume rendering or misconfigured Autopilot schedules.
  • You must comply with the Acceptable Use Policies of OpenAI and ElevenLabs. Generating hate speech, deepfakes, or explicit content may result in your API keys being revoked by those providers.

4. CinematicAI Credit System & Billing

In addition to your own API keys, CinematicAI uses a proprietary Credit System to cover cloud-rendering and software costs.

  • Video Renders: Generating a standard video consumes Credits as defined in our Pricing documentation (e.g., 2 credits for <30s videos).
  • Refunds: If a video render fails due to a CinematicAI server error, credits are automatically refunded. However, credits are not refunded if a render completes successfully but you are unsatisfied with the AI's creative choices.
  • Subscriptions: Monthly subscriptions are billed in advance. You may cancel at any time, but we do not offer pro-rated refunds for unused days in a billing cycle.

5. Content Ownership and Copyright

You retain 100% ownership and copyright of all videos, scripts, and audio generated through your CinematicAI account, provided you maintain an active license with the underlying API providers. CinematicAI claims no ownership over the final rendered videos, and you are free to monetize them on YouTube, TikTok, Instagram, or any other platform.

6. Prohibited Conduct

You agree not to use CinematicAI to:

  • Generate illegal, defamatory, or harmful content.
  • Automate spam campaigns that violate third-party platform rules.
  • Attempt to reverse-engineer, scrape, or exploit the CinematicAI rendering engine or database.

Violation of these rules will result in immediate account termination without a refund.

7. Limitation of Liability

To the maximum extent permitted by law, CinematicAI and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or channel monetization, arising from your use of the service.
